We have extensive experience in all major types of commercial real estate transactions, including property transfers, real estate financing transactions, commercial leasing, condominium law, joint ventures, real estate development, foreclosures, construction, mechanics liens, private placements, tenancies in common (TIC), and 1031 Exchange planning.

The firm’s attorneys have handled numerous, complex acquisitions and dispositions of developed and undeveloped commercial real estate throughout the country. One recent property acquisition included the simultaneous purchase of mechanics lien judgments and attendant rights to allow the buyer to release all liens on the target property and pursue recovery against the judgment debtor. One recent series of property dispositions involved the subdivision of farmland and the sale of multiple parcels to various retail developers while establishing covenants and easements necessary for the sale of additional parcels and future development.

Our attorneys have negotiated and favorably closed many commercial real estate based lending transactions with major banks, including commercial mortgage backed securities (CMBS) loans. We have also assisted our real estate clients with private placements of capital to facilitate investments in their commercial properties. The firm has further assisted its commercial clients with 1031 Exchange planning to allow them to manage the tax consequences of real estate dispositions, including the tenancy in common (TIC) structuring of purchasing entities and investment groups to facilitate multiple sources of acquisition funding in conjunction with such 1031 Exchanges.

The firm’s attorneys have worked with numerous condominium associations (including commercial, residential, and mixed-use) to prepare governing documents and to revise pre-existing governing documents to achieve client goals. We have assisted such associations with enforcement of bylaws against association members and counseled associations how to comply with their own governing rules and regulations. We have also recovered substantial amounts of unpaid assessments through negotiation and, when necessary, foreclosure of assessment liens.

Our attorneys have negotiated many commercial leases for both landlords and tenants involving numerous different types of commercial properties (office, retail, industrial and ground leases). We have also enforced such commercial leases on behalf of both landlords and tenants, including commercial lease terminations and evictions.
